Administrative Reporting

You may report to the campus Civil Rights Team any incident of Sex Discrimination, Sexual Harassment, or Sexual Exploitation (including Rape, Acquaintance Rape, Dating Violence, Domestic Violence and Stalking). A Civil Rights Team member will discuss with you any reasonable supportive measures the University may offer prior to conclusion of an investigation or potential disciplinary action to reduce or eliminate negative impact on you and provide you with available assistance.

Criminal Reporting

Some forms of misconduct prohibited under the Nondiscrimination Policy may also be prohibited by law. You have a right to be informed of law enforcement options and information regarding the availability of a criminal or civil prosecution for victims of crime. It is a victim’s/survivor’s choice to report a crime. You have the right to report or decline to report an incident to law enforcement. You have the right to not be forced, coerced, or pressured into reporting to law enforcement. A victim/survivor may report an incident to law enforcement at any time.

In the event of an emergency where immediate assistance is required, a victim/survivor should dial 9-1-1 to be connected with the nearest police department. If there is no emergency, victims/survivors can file a police report at any time in the jurisdiction where the assault occurred. A confidential victim advocate can assist the victim/survivor in filing the report if requested. Victims/survivors of crimes such as sexual assault, sexual exploitation, stalking, dating violence, domestic violence, abuse, threats of abuse and/or serious harassment all have a right to petition the court in the appropriate jurisdiction for a protective order (also referred to as a restraining order). Your Campus Advocate, University Police Department and Title IX Coordinator are all able to provide you with more information about pursuing criminal prosecution, civil prosecution and/or protective orders.

However, with the passage of time, the ability to gather evidence to assist with criminal prosecution may be limited. Depending on the circumstances, the police may be able to obtain a criminal restraining order on your behalf. The university police department has mutual agreements with all agencies in Alameda and Contra Costa Counties. In case of a parallel investigation, information regarding the incident shall be shared exclusively on a "need to know" basis.

Confidential Support

Confidential Advocate

The Confidential Advocate is a counselor and sexual assault advocate here exclusively to talk to and advocate for survivors, and those impacted by sexual violence including: sexual harassment, dating and intimate partner violence, sexual assault, stalking, and sexual exploitation. The confidential advocate serves the entire campus community; students, faculty, staff and affiliates.

Student Health & Counseling Services

You may choose to seek advice and assistance from physicians, psychotherapists, professional counselors, sexual assault and domestic violence counselors and advocates. Cal State East Bay's on-campus Student Health and Counseling Services (SHCS) center is staffed with trained counselors and medical staff who can provide immediate (as well as ongoing) confidential support and can discuss your options with you.

Non-Reporting

You are strongly encouraged to report any incident of Sexual Violence to the police and/or campus Title IX Coordinator so that steps may be taken to protect you and the rest of the campus community. However, non-reporting is also an option.

When the Investigation is Limited by Confidentiality

In cases where the university’s ability to investigate a complaint is limited due to the victim’s request for confidentiality, Cal State East Bay will take a comprehensive approach to preventing sexual assault. This includes taking steps to limit the effects of the alleged sexual misconduct and prevent its recurrence without initiating formal action against the alleged perpetrator.

Examples of actions that can be taken include: 

• providing increased monitoring, supervision, or security at locations or activities where the misconduct occurred
• providing training and education materials for students and employees; revising and publicizing the school’s policies on sexual misconduct
• conducting climate surveys regarding sexual misconduct.
